 Who are we?

Ebike Electric Cycle Centres Ltd, trading as Ebike Centres is a retail store selling new and used electric and non electric bikes from within store and on-line. Ebike Centres also conducts servicing and repairs to bikes. We are a limited company registered in England Wales whose registered office is 102 Granby Street, Leicester LE1 1DL. Ebike Electric Cycle Centres Ltd (‘Ebike Centres’) are a UK based company registered in England (company number 08210221). The following Terms & Conditions (‘Terms’) relate to all sales made through this web site. By making a purchase through this web site you (the ‘buyer’) agree to accept these Terms. These Terms & Conditions replace and supersede any previous Terms and Conditions. Ebike Centres reserves the right to vary these Terms at any time. Any waiver of these Terms between Ebike Centres and the buyer on any occasion shall merely act as a waiver on that occasion, and shall not affect the Seller’s right to enforce these Terms & Conditions on any further occasion. These Terms and Conditions do not affect your statutory rights.

Website accuracy

We take great care to ensure the accuracy of all prices and descriptions, and the availability of goods on this web site. Should an error occur we reserve the right to correct the error and notify you if you have made an order. At this time no contract will be deemed to have been entered into and you will have the opportunity to accept the modified price / description or receive a full refund with no further liability. All goods offered are subject to availability and offers may be withdrawn at any time.

Difference between an ‘order’ and a ‘sale’

The receipt of your order does not constitute a sale. During the ordering process we may issue an acknowledgement of your order (electronically, verbally or otherwise) in order to confirm that your order has been safely received. This acknowledgement does not constitute a sale. Upon receipt of your order we will check the details to confirm price, description and availability. If any errors are found at this stage they will be brought to your attention as soon as possible and you will be offered the choice of a full refund (with no further liability) or a revised order. A sale will occur when full payment has been received by Ebike Centres and the goods have been dispatched to you.

Pricing on this web site

Prices displayed are in UK Sterling and are inclusive of VAT. We are VAT registered. Prices on this web site may differ from prices in our retail stores or associated suppliers. We are not obliged to offer retail store customers the same prices as are displayed on this web site or vice versa. Any prices offered by our retail store through media, advertisement, promotion, scheme, word of mouth or any other means will not necessarily be honoured by this web site, and vice versa.

Overseas customers purchasing goods through this web site are responsible for checking their liability for tax and VAT in any country other than the UK.

Click and collect

You may purchase your goods online through our website using click and collect. Once you have received an acknowledgement of your order from us, we may call you to confirm your order and check on size, colour etc. We will then hold the item in-store for you to collect within one week, or longer with our prior written consent. If goods are not collected within one week, and no prior consent has been given, we reserve the right to charge a storage fee of £5 per day.

Your personal information

Whenever you make a purchase online by credit / debit card, Paypal, charge card and by other means you are accepting that your account provider or card issuer will validate your account before authorising payment to us. We must receive their authorisation before delivering goods to you. In addition, for your protection, we reserve the right to carry out additional checks to verify your name, address and other information connected with your order. This may involve checking the information you have given us against publicly and commercially available data, by ourselves or third parties such as credit reference agencies. Alternatively we may contact you by telephone, email or letter to verify your identity. These precautions are taken for your protection. We will hold your details securely and not pass your information to anyone except authorised credit reference agencies, delivery agents or the manufacturer of your goods (for warranty purposes) without your consent unless legally obliged to do so.

Warranties and guarantees

All new goods sold come with a minimum of six months warranty. Pre-owned goods may or may not come with warranty. All warranties and guarantees are strictly subject to the goods being used for the purpose for which they are commonly intended, without being subjected to misuse.

It is a condition of your warranty that you must present your purchase receipt for any warranty claim.

Where goods come with a manufacturer’s warranty the manufacturer will determine whether a warranty claim is valid. Any disputes must be taken up with the manufacturer direct.

In the case of bicycles, warranties do not include parts which are subject to ‘wear and tear’ such as tyres, brakes, spokes, wheel rims etc. or faults caused by misuse.

Electric bikes must be maintained regularly to keep them in good condition, and the owner is expected to maintain and lubricate moving parts. Regular servicing by a professional cycle mechanic will ensure good performance for many years. This includes extensive rain damage and other weather damage. Electric engines, controllers and components, whilst designed to be weather and water resistant, are not water proof. The warranty may be invalidated if the bike is not kept indoors or undercover.

If the nature of the problem is such that it requires professional attention, you may return the product to us for repair within the warranty period. Goods must be clean and not covered in dirt and oil. If the bike has been in anyway tampered with or modified then this will invalidate the warranty.. If an item needs to be returned then the customer is responsible for getting the item to our premises. This includes meeting the packaging and postage (courier) costs. The customer is fully responsible for ensuring that the goods arrive with us in good condition.

Battery warranties do not include misuse of the battery such as not following the manufacturer’s guidelines for charging, discharging and storing the battery. Any anti-tamper stickers must be intact for any warranty claim.

Returns

Your rights when returning goods

Our Returns Policy complies with two pieces of legislation – the Consumer Rights Act 2015 and the Consumer Contracts Regulations.

Your statutory rights are not affected by our Returns Policy. To the extent that any provision in our Returns Policy conflicts with your statutory rights, your statutory rights will prevail and the particular offending provision in our Returns Policy will be deemed inapplicable.

Online purchase Returns (refunds and exchanges)

If you are unhappy with your item, please let us know. Our Returns Policy gives you 30 days to return or exchange an item bought online with a valid receipt. If 30 days have gone by since your purchase, we cannot offer you a refund or exchange.

To be eligible for a refund or exchange, goods must be returned in a re-saleable condition. That means your item must be unused and in the same condition that you received it. The item must be in the original packaging and returned with any accessories, labels and “free gifts” or bonus items.

To complete your refund or exchange, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer.

Under the Consumer Rights Act you have an early right to reject goods that are unsatisfactory quality, unfit for purpose or not as described, and get a full refund.

But this right is limited to 30 days from the date you took ownership of the goods (this could be the date of purchase or the date the goods were delivered to you – whichever is later).

After the initial 30 days, you can’t demand a full refund in the first instance, but you still have the right to a repair or replacement

In-store purchase Returns

Faulty items

If an item is being returned within 30 days of purchase date due to a fault, the retailer reserves the right to choose to rectify the fault, exchange the item or offer a refund. Any rectification work must be completed within 28 days of the date of return. If rectification work is not completed within 28 days the retailer can offer to either exchange the item or offer a refund

If 30 days have gone by since your purchase, we cannot offer you a refund or exchange.

Non-faulty items

We do not accept returns on non-faulty items.

Refunds (if applicable)

If you post a return item back to us, your returned item will be inspected and we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If a refund is accepted, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 14 calendar days. If you paid for standard delivery of the goods, the cost of standard delivery will also be refunded.

There are certain situations where only partial refunds are granted (if applicable):

  1. Books or other paper products with obvious signs of use;
  2. Any item not in its original condition, which is damaged or missing parts for reasons not due to our error; and
  3. Any item that is returned more than 30 days after

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

Refunds on Sale Items

We do not offer refunds for Sale Items, unless they are faulty.

Liability

The owner is responsible for safe and legal use of goods supplied to them, including the minimum age limits for the use of electric bicycles and ensuring that other persons using the products are capable of doing so safely.

We accept no liability for death or personal injury unless caused directly by the negligence of Ebike Centres in circumstances where products have been assembled otherwise than strictly in accordance with the instructions received with the product or where alterations / modifications and/or poor or irregular servicing / maintenance to goods have been made.

Deposits

In all cases, whether taken online or in-store, a deposit is non-returnable. Any deposit paid to Ebike Centres, whether to hold an item already in stock or to order in an item as a special request for a customer, will be retained by Ebike Centres to cover the loss of any potential sale if a customer later decides not to proceed. If an item has been specifically ordered in by Ebike Centres at the request of the customer and the customer later cancels, the customer is responsible for any losses incurred by Ebike Centres up to the full value of the item. Deposits will only be returned in exceptional circumstances for example where Ebike Centres cannot fulfil the order/promise within a reasonable timescale.

Uncollected items / property left on our premises

Bikes, scooters and any other items left at Ebike Centres for servicing, repair or any other reason, are left entirely at the owner’s risk and Ebike Centres does not accept any liability for any accidental damage which may be caused to them. When you leave your item with us we will give you an estimated date and time by which it will be ready for collection. We strive to complete all work as quickly as possible, as we have very limited storage space. Once your bike is ready for collection we will contact you by phone or email to inform you, and ask you to collect it. We require you to collect your item within three working days unless otherwise agreed, after which we will charge a storage fee of £5 per day until you collect your item. At the end of one month we reserve the right to sell your property for whatever we can, and use this payment towards covering the costs of your repairs and storage. The surplus (if any) will be paid back to you.

Theft / Stolen items

When a customer leaves their bike, scooter or other item at Ebike Centres store they are deemed to have read our Terms and Conditions.

Bikes, scooters and any other items left at Ebike Centres for servicing, repair or any other reason, are left entirely at the owner’s risk and Ebike Centres does not accept any liability for theft. At the complete discretion of the store, Ebike Centres may choose to make an insurance claim to recover your loss. In such case, the insurance company may reimburse up to the ‘Fair Market Value’ of the item(s) stolen. Fair Market Value is the value that the item would sell on the open market, not the new replacement cost. Any dispute between Ebike Centres and the customer is considered a ‘civil’ matter and not a ‘criminal’ matter (the Police do not deal with a civil matters). If the customer wishes to raise a dispute with the store the customer should contact the Citizens Advice Bureau;  citizensadvice.org.uk  or telephone 08082231133. The customer may choose to consider taking legal action to recover lost funds.

Sale items

Sale items are items being offered for sale below the original Recommended Retail Price (RRP). These items include Clearance offers, discounted items and pre-owned items.

Sale price The price of sale items is based on a cash transaction. Unless otherwise agreed the following levies are applied to all sale prices:

  • Cycle to Work schemes – add 18%
  • Interest Free Finance#
    • ‘Pay Later’ – add 2%
    • ‘Pay in 3’ – add 4%
    • ‘Interest free 1 year’ – add 5%
    • ‘Interest free 2 years’ – add 10%
    • ‘Interest free 3 years’ – add 13%
  • Payment by American Express – add 2%
  • Payment by credit card – add 1%
  • Payment by debit card – add 0.5%

# Interest free credit is only available based on the original RRP of the item.

Jurisdiction

Notwithstanding any rule of contract to the contrary, these Terms and Conditions and any internet sales, contract or agreement arising from them shall be deemed to have been made in England and shall be interpreted in accordance with English Law and industry custom and practice. Any disputes in respect of them shall be determined by English Courts.
